Won't stay latched

Bought an H&R single shot break down rifle in .308 caliber. Deal is, when I load a shell in the barrel and close the breech, the barrel is locked and can not be pulled open, but when I shoot the rifle the break open action releases without having to push the break down lever.
Does anyone have a suggestion about what could be wrong and how to fix it?

No danger, the gun is unlocking after the pressure has dropped. The problem can be corrected with a different lock or new spring, but I can't tell without actually seeing the gun.

Before you send it in or otherwise have it "fixed", make sure the latch and latch shelf are dry, and I mean dry. This is the prime cause of unlatching rather than something not fitting properly. Here endeth the lesson. Goatwhiskers the Elder
