Repair/Replace shipping?

As I understand the law, an individual - not an FFL holder - is allowed to ship a handgun to the manufacturer or other FFL holder for the purposes of repair . . . if the pistol is to be REPLACED, not repaired, does the replacement have to go through an FFL, or can the manufacturer fill out some form and ship the replacement to the original owner after he returns the defective pistol?

According to federal law a replacement firearm can be returned directly to the seller. This usually happens when the manufacturer or distributor has the old firearm and cannot repair it.

State laws may not allow this procedure or might require some other action after receipt (i.e., registration).

According to communicatin with S&W of just a few months ago, the replacement arm must be sent to a FFL holder who has a signed copy of their license on file with them.

Soooo...they sent one that was left with a person that was not named on the shipping papers, did not have a license, was not associated with the dealer involved and who had no knowledge of what was goin on. Lucky, honest person who then delivered it to the addressee.

Only stipulation on the package was "Adult Signature Required"

Who ya gonner believe ?
