Over at the "Potomac Institute", an anti-gun site, they're gloating over the apparent fact that out of the HUGE heap of amicus briefs filed by everybody and their kid sister, NOT ONE HAS BEEN FILED BY A PRO-GUN ORGANIZATION! Or, for that matter, by any Second amendment scholar I recognize. On the other hand, there have been amicus briefs filed by every anti-gun group in existance.

Amicus Curiae...person(s) invited to advise the court on a matter of law to which they are not a party

Now lets consider the following:
1) Judge Cummings found in favor of Emerson, this case before the 5th district is an appeal, filed by the Feds. Amici briefs are used to present evidence or opinion to the court in question that either may not have been considered, may be new, etc in the original case....i.e. its "advice" to the court to consider that the original verdict deserves to be overturned. Remember, courts do tend to give weight and leeway to the lower court, especially in an appeal. Pro-gun sentiments and organizations may not be eligible to file amici in this instance because they won the original.
2) If the NRA, GAO, et al are offering legal services in this case then they are not eligible as "amici curiae" as they are a party.
3) All the pro-gun orgs have been touting Emerson and chomping at the bit over it....Do you honestly believe there would not be a single amicus brief filed on the pro-Emerson side if they were eligible or allowed...by anyone? Why not by any personal friends of Emerson? The definition of "invited to advise" implies there is some type of standards, eligibility, reason etc.

Basically I believe amici are only allowed on the losing side.

Well, that DOES seem like a reasonable explaination; While I'm ready to believe that the NRA might fail to file an amicus in a case like this even if allowed, that EVERY pro-gun organization and individual would fail to file seemed a bit beyond belief. I was starting to wonder if some clerk had sorted through the applications and thrown ours out!

On the other hand, I'm sure I've heard of cases where there were opposing amicus briefs. Is there a lawyer out there who can confirm this explaination? So I can confidently tell off the gloaters?

BTW, as you might imagine, "GEE" is going through his site, deleting my posts. Isn't it pathetic how predictable he is?

I just did a search...over 5000 hit on AC and all I read (not all 5000) were either in appeals courts to convince the court to reverse or in supreme courts...thats where I found AC representing both sides.


BTW....I've forgotten my Latin....plural of "amicus" is "amicae"......not amici (which is the plural in Italian :))

Ok, we at last have an explaination: The deadline for filing an amicus brief asking that the lower court be upheld is later than the deadline for filing one asking that it be struck down; We get to read THEIR briefs before writing our own! Finally, something in the legal system works FOR us!
