Are folding stocks on new shotguns legal?

Specifically, if I remove a fixed stock on a new shotgun and replace it with a folding stock, is that legal?

if it's a pump, then it's legal

It is legal, assuming: (1) you comply with the overall length requirements of the NFA34; (2) if a semi-auto, the shotgun is a pre-ban shotgun under the 1994 Crime Bill -- there are still NIB pre-ban shotguns out there, I've seen them at gunshows; and (3) you comply with all applicable state and local laws.
